1. WHAT INFORMATION DO WE COLLECT?
Personal information you give us
In short: We collect personal information that you provide to us.
We collect personal information you voluntarily provide when you create an account, make a purchase, sign up for our newsletter, fill out a form, leave a comment, or contact us. This may include:
- Names
- Email addresses
- Usernames and passwords
- Mailing or billing address (if you choose to add one)
- Purchase and membership history
- Your activity in your account, such as course progress and favorites
- Anything you choose to share in forms, comments, testimonials, or messages to us
Sensitive information. We do not process sensitive personal information.
Payment data. When you make a purchase, your payment details (such as your card number and security code) are collected and stored by our payment processors, Stripe and PayPal. We do not store your full card details. These processors may also collect device information to help prevent fraud. You can read their privacy notices here: https://stripe.com/privacy and https://www.paypal.com/us/legalhub/privacy-full.
All personal information you provide must be true, complete, and accurate, and you should let us know of any changes.
Information collected automatically
In short: Some information, such as your IP address and device details, is collected automatically when you use our website or app.
When you visit, use, or navigate our Services, we and our partners automatically collect certain information. This does not directly reveal your identity, but may include:
- Log and usage data: your IP address, browser type and settings, pages and content viewed, searches, features used, dates and times of use, referring URLs, and error reports.
- How you found us: the website, ad, or campaign that brought you to us, so we can understand which of our marketing is working.
- Device data: device model, operating system, device and advertising identifiers, language preferences, and internet service provider or mobile carrier.
- Approximate location: a general location (such as country, region, or city) based on your IP address. We do not collect your precise GPS location.
Much of this information is collected through cookies, pixels, and similar technologies, including tools from Google and Meta (Facebook). Because our mobile app displays our website, these same technologies also run inside the app. See Section 5 for details.
Information from third parties
We may receive limited information from third parties, such as payment and subscription confirmations from Stripe and PayPal, and reports from advertising and analytics partners about how our ads and content are performing.
2. HOW DO WE PROCESS YOUR INFORMATION?
In short: We process your information to provide and improve our Services, communicate with you, measure our marketing, keep things secure, and comply with the law.
- To create and manage your account, including login and access to courses, meditations, and member content.
- To fulfill and manage your orders, payments, memberships, and refunds.
- To communicate with you, including sending our newsletter, updates, and service messages. You can unsubscribe from marketing emails at any time.
- To respond to your questions and provide support.
- To understand and improve our Services through analytics.
- To advertise and measure our marketing, including showing ads on platforms like Facebook, Instagram, and Google, and measuring which ads lead to sign-ups and purchases (conversion tracking).
- To keep our Services secure and prevent fraud and spam.
- To comply with legal obligations, such as tax and accounting requirements.
- To protect someone’s vital interests, such as preventing harm.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
In short: We only process your personal information when we have a valid legal reason to do so.
If you are located in the EU or UK, this section applies to you. The GDPR and UK GDPR require us to explain the legal bases we rely on:
- Consent. For example, for marketing emails and advertising cookies. You can withdraw your consent at any time (see Withdrawing your consent).
- Performance of a contract. To provide the Services and memberships you sign up for.
- Legitimate interests. To understand how our Services are used, improve them, and keep them secure, where this does not override your rights.
- Legal obligations. For example, keeping purchase records for tax purposes, or responding to lawful requests from authorities.
- Vital interests. Where necessary to protect someone’s safety.
If you are located in Canada, this section applies to you. We may process your information with your express consent, or where consent can be reasonably inferred (implied consent). You can withdraw your consent at any time. In some exceptional cases, the law allows us to process your information without consent, for example for fraud detection and prevention, to comply with a subpoena, warrant, or court order, or where the information is publicly available as specified by regulation.
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In short: We share information with trusted service providers who help us run Club Qigong, and with advertising partners for advertising and conversion tracking.
Service providers. We work with vendors who perform services on our behalf and need access to certain information to do that work. These include:
- Website and app hosting providers
- Payment processors (Stripe and PayPal)
- Email and newsletter services, which may track whether our emails are opened and which links are clicked
- Video hosting and streaming services
- Data analytics services
- Customer support and form tools
Advertising partners. We use advertising and measurement tools from partners such as Google and Meta (Facebook and Instagram). Through pixels on our website and app, and through direct server-to-server connections (such as Meta’s Conversions API), these partners may receive information such as:
- Pages you view and actions you take (such as signing up or making a purchase)
- Device information, identifiers, and IP address
- Your name and email address, which are typically scrambled (hashed) before they’re sent, to help match conversions to ads
We use this to show our ads to people who may be interested in Club Qigong and to measure how well our ads work. These partners handle this information according to their own privacy policies, including Google’s (https://policies.google.com/privacy) and Meta’s (https://www.facebook.com/privacy/policy).
Affiliate links. Some pages include affiliate links (such as Amazon affiliate links). If you click one, the retailer may know you came from our site.
Business transfers. We may share or transfer your information in connection with a merger, sale of company assets, financing, or acquisition of all or part of our business.
Legal requirements. We may disclose information where required by law, such as in response to a court order or to protect our rights.
We do not sell your personal information for money.
5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In short: Yes. We use cookies, pixels, and similar technologies to run our Services, understand how they’re used, and measure our advertising.
Essential cookies. When you log in, we set cookies to save your login information and display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me,” your login will persist for two weeks. If you log out, the login cookies are removed. If you visit our login page, we set a temporary cookie to check whether your browser accepts cookies. It contains no personal data and is discarded when you close your browser.
Comment cookies. If you leave a comment, you may choose to save your name, email address, and website in cookies so you don’t have to fill them in again. These cookies last for one year.
Analytics and advertising technologies. We use tools such as Google Analytics, Google Ads, and the Meta (Facebook) Pixel to understand how people use our Services and to measure and improve our ads. See Section 4 for what these partners receive.
Other tools. Our email newsletter service, embedded video players, and payment processors may also set their own cookies or use similar technologies to deliver their services, measure engagement, and prevent fraud. We also use cookies to remember which website or ad referred you to us.
Your choices. Most browsers let you block or delete cookies, though this may affect how some features work. To opt out of interest-based advertising, visit https://youradchoices.com/. You can also manage your ad preferences directly in your Google and Facebook account settings.
6. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES AND EMBEDDED CONTENT?
In short: We are not responsible for the privacy practices of other websites, apps, or embedded content.
Our Services may link to third-party websites, services, or apps that we do not control. Including a link does not mean we endorse them, and we are not responsible for their content or privacy practices. Please review their policies directly.
Articles on our site may include embedded content (such as videos, images, or articles). Embedded content from other websites behaves as if you had visited that website directly. Those websites may collect data about you, use cookies, embed additional tracking, and monitor your interaction with the embedded content, including if you have an account and are logged in to that website.
7. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?
In short: Our servers are in the United States, and your information may be processed there and in other countries.
If you access our Services from outside the United States, your information may be transferred to, stored, and processed in the United States and in other countries where our service providers and partners operate. These countries may not have data protection laws as comprehensive as those in your country, but we take reasonable steps to protect your information in line with this notice and applicable law.
8. HOW LONG DO WE KEEP YOUR INFORMATION?
In short: We keep your information only as long as needed, unless the law requires us to keep it longer.
- Account and profile information is kept while your account is active. If you request deletion, we remove it within 30 days.
- Newsletter information is kept until you unsubscribe or request deletion.
- Purchase and billing records (name, email, and transaction details) are kept for up to 7 years to meet tax and accounting requirements, even after account deletion. They are used only for legal and tax compliance.
- Comments and their metadata are kept indefinitely so we can recognize and approve follow-up comments automatically, unless you ask us to delete them.
When we no longer need your information, we delete or anonymize it. If that isn’t immediately possible (for example, because it is stored in backup archives), we securely store it and isolate it from further use until deletion is possible.
9. HOW DO WE KEEP YOUR INFORMATION SAFE?
In short: We protect your information with encryption and other reasonable safeguards.
All data sent between your device and our website and app is encrypted in transit using HTTPS. We also use reasonable organizational and technical measures to protect the information we process. However, no transmission over the internet or storage system can be guaranteed to be 100% secure, so we cannot promise that unauthorized parties will never be able to access your information. Please use our Services in a secure environment.
10. DO WE COLLECT INFORMATION FROM MINORS?
In short: We do not knowingly collect data from or market to children under 18 years of age.
By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to their use of the Services. If we learn that we have collected personal information from someone under 18, we will deactivate the account and promptly delete the data. If you become aware of any such data, please contact us at info@clubqigong.com.
11. WHAT ARE YOUR PRIVACY RIGHTS?
In short: Depending on where you live, you may have rights to access, correct, delete, or control how your information is used. You can also delete your account at any time.
Depending on your location (such as the EEA, UK, Canada, or certain U.S. states), you may have the right to:
- Access and get a copy of your personal information
- Correct inaccurate information
- Request deletion of your information
- Restrict or object to certain processing
- Data portability (receive your data in an exported file)
- Opt out of targeted advertising
To make a request, use the contact details in Section 16. For deletion, use https://clubqigong.com/data/. We will act on requests in line with applicable data protection laws.
If you are in the EEA or UK and believe we are processing your information unlawfully, you can complain to your local data protection authority: https://ec.europa.eu/justice/data-protection/bodies/authorities/index_en.htm.
If you are in Switzerland, you can find the data protection authority here: https://www.edoeb.admin.ch/edoeb/en/home.html.
Withdrawing your consent. Where we rely on your consent, you can withdraw it at any time by contacting us. This will not affect processing that happened before you withdrew, or processing based on other legal grounds.
Opting out of marketing emails. You can unsubscribe at any time using the link in any of our emails, or by contacting us. We may still send you service-related messages about your account or purchases.
Account information. To review or change your account information, log in to your account or contact us. To delete your account and data, use https://clubqigong.com/data/. When you request deletion, we remove your account and information from our active databases, except for information we must keep for legal, tax, fraud-prevention, or security purposes (see Section 8).
Cookies and ads. See Section 5 for how to control cookies and opt out of interest-based advertising.
If you have questions about your privacy rights, email us at info@clubqigong.com.
12. CONTROLS FOR DO-NOT-TRACK FEATURES
Some browsers and devices include a Do-Not-Track (“DNT”) setting. Because there is no uniform standard for recognizing DNT signals, we do not currently respond to them. If a standard is adopted that we must follow, we will update this notice.
13. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In short: Yes. California residents have specific rights regarding their personal information.
“Shine the Light.” California Civil Code Section 1798.83 lets California residents request, once a year and free of charge, information about the categories of personal information we disclosed to third parties for direct marketing purposes in the prior calendar year, and the names and addresses of those third parties. Please submit your request in writing using the contact information below.
CCPA Privacy Notice
The California Code of Regulations defines a “resident” as (1) every individual who is in California for other than a temporary or transitory purpose, and (2) every individual domiciled in California who is outside the state for a temporary or transitory purpose. Selling and sharing. We have not sold personal information for money in the past twelve (12) months. However, under California law, allowing advertising partners such as Google and Meta to receive information through pixels for targeted advertising counts as “sharing.” In the past twelve (12) months, we have shared Categories A, D, F, and G with advertising partners for cross-context behavioral advertising and conversion measurement.
