These Terms and Conditions (“Terms“) are an agreement between you and Moody House LLC, doing business as Club Qigong (“Club Qigong,” “we,” “us,” or “our“). They apply to our website at https://clubqigong.com, the Club Qigong mobile app for Android and iPhone, our courses, meditations, podcast, newsletter, and everything else we offer (together, the “Services“).
By using the Services, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Services. Club Qigong is for education and general wellness. It is not medical advice, and you practice at your own risk.
1. Health and medical disclaimer
All content on the Services, including qigong movements, exercises, breathwork, meditations, affirmations, podcasts, articles, videos, and product recommendations, is for educational and informational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for care from a licensed healthcare professional.
- Always consult your doctor or a qualified healthcare provider before starting any exercise, breathwork, nutrition, diet, meditation, or wellness program, especially if you are pregnant, post-natal, post-surgical, elderly, have a pre-existing injury or medical condition, or take medication.
- Never ignore professional medical advice or delay seeking it because of something you saw or heard on Club Qigong.
- Content that mentions specific health conditions describes general practices that some people find supportive. It does not claim to diagnose, treat, cure, or prevent any disease, and it has not been evaluated by the U.S. Food and Drug Administration (FDA).
- Our meditations and emotional wellness content are not therapy or mental health treatment. If you are struggling, please reach out to a licensed professional.
- The Services are not for emergencies. If you think you may be having a medical emergency, call 911 or your local emergency number right away. If you are in emotional crisis in the U.S., you can call or text 988 to reach the Suicide & Crisis Lifeline.
“Medical qigong” and similar terms describe a traditional practice rooted in Chinese medicine. They do not mean that Club Qigong or its instructors are licensed medical providers or that our content is a medical service.
2. Assumption of risk, release, and waiver
Qigong and other exercises involve physical movement, balance, stretching, and breathing techniques. As with any physical activity, there is a risk of injury, including serious or disabling injury, that cannot be completely eliminated.
By using the Services, you agree that:
- You alone are responsible for deciding whether to practice, how much to do, and whether an exercise is right for your body. You participate voluntarily and at your own risk.
- You will listen to your body and stop immediately if you feel pain, dizziness, shortness of breath, discomfort, or distress, and seek medical help if needed.
- If you are pregnant, become pregnant, are post-natal or post-surgical, or have any medical condition, your use of the Services confirms that you have your physician’s approval to participate.
- You will practice in a safe, clear space, and never listen to meditations or relaxation content while driving, operating machinery, or doing anything that requires your full attention.
- You assume full responsibility for any risks, injuries, or damages that may result from your participation.
To the fullest extent permitted by law, you release, waive, and discharge Moody House LLC, Club Qigong, and their owners, officers, employees, instructors, contractors, and affiliates from any and all claims, now or in the future, arising from or related to your use of the Services or participation in any practice, including claims based on negligence.
3. Results and testimonials
Testimonials and stories shared on the Services are the personal experiences of individual members. Individual results vary, and we make no promise or guarantee of any particular health, fitness, weight, emotional, or other outcome. Your results depend on many factors, including your health, consistency, and circumstances.
4. Eligibility and accounts
- You must be at least 18 years old to create an account or make a purchase.
- You agree to provide accurate information and to keep your login details secure. You are responsible for all activity on your account.
- Memberships are for one person. Sharing your login or account with others is not allowed.
- Please let us know right away if you believe someone has accessed your account without permission.
5. Memberships, billing, and cancellation
- Automatic renewal. Monthly and yearly memberships renew automatically at the end of each billing period, and you authorize us (through our payment processors, Stripe and PayPal) to charge your payment method at the then-current rate until you cancel.
- Cancel or pause anytime. You can cancel or pause at https://clubqigong.com/membership-adjust/ or by contacting us. Cancellation stops future charges. You keep access until the end of the period you already paid for.
- Our 30-day happiness guarantee. π Your satisfaction is our main priority. If you’re not happy for any reason, just contact us within 30 days of any order or renewal charge, and we’ll refund that payment in full. Refunds go back to your original payment method. Requests made after 30 days aren’t eligible, except where required by law.
- Price changes. We may change prices in the future. We’ll give you notice before a new price applies to your membership, and you can cancel before it takes effect.
- Failed payments. If a payment fails, we may pause or end your access until it is resolved.
- Purchased courses. Courses you purchase or save to keep remain available to you for as long as we continue to operate the Services, subject to these Terms.
- Gift certificates. Gift certificates can be refunded to the purchaser within 30 days of purchase if they haven’t been redeemed. They have no cash value and cannot be resold.
6. Our content and how you can use it
All content on the Services, including videos, audio, meditations, courses, text, images, graphics, music, logos, and the Club Qigong name, is owned by Moody House LLC or its licensors and is protected by copyright, trademark, and other laws.
We grant you a personal, limited, non-exclusive, non-transferable license to access the Services and download content for your own private, non-commercial use. You may not:
- Share, sell, resell, rent, publish, stream, broadcast, or redistribute our content
- Upload our content to other websites, apps, social media, or file-sharing services
- Use our content to teach classes, run a business, or create competing products
- Use our content to train artificial intelligence or machine learning models
- Copy, scrape, or bulk-download the Services using automated tools
- Remove any copyright or ownership notices
7. Content you share with us
When you send us feedback, comments, testimonials, reviews, questions, or other submissions, you give Moody House LLC a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, edit, display, and share them, including in our marketing, with your first name or initials. You confirm that you have the right to share what you send, and that it is truthful. You can ask us to stop using a testimonial in future materials at any time by contacting us.
Please don’t post anything unlawful, harmful, hateful, harassing, or that violates someone else’s rights. We may remove any submission at our discretion.
8. Acceptable use
You agree not to misuse the Services, including by attempting to hack, disrupt, or overload them, accessing areas you are not authorized to access, using the Services for any unlawful purpose, or impersonating anyone.
9. Affiliate links and product recommendations
We sometimes share products we love. When you click a link and make a purchase, Club Qigong may earn a small commission at no extra cost to you. It helps support our work. As an Amazon Associate, we earn from qualifying purchases.
Product recommendations are our personal opinions only. We are not responsible for third-party products, their safety, or their results. Please follow the manufacturer’s instructions and check with your healthcare provider before using any supplement or health product.
10. Third-party websites and services
The Services may link to or include content from third-party websites and services that we don’t control. Links do not imply endorsement, and sites can change without notice. We are not responsible for their content, products, privacy practices, or terms. Please review their policies before using them.
11. Disclaimer of warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We don’t guarantee that the Services will be uninterrupted, error-free, secure, or available at any particular time. All information is published in good faith, but any action you take based on it is strictly at your own risk.
12. Limitation of liability
To the fullest extent permitted by law, Moody House LLC, Club Qigong, and their owners, officers, employees, instructors, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Services, even if we were advised of the possibility of such damages.
Our total liability for any claim arising from or related to the Services or these Terms will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100.
Some places do not allow certain limitations of liability, so some of these limits may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Moody House LLC, Club Qigong, and their owners, officers, employees, instructors, contractors, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of anyone else’s rights.
14. Changes to the Services
We may add, change, or remove content, features, or pricing, or pause or discontinue any part of the Services, at any time. We’ll try to give reasonable notice of significant changes that affect your membership.
15. Suspension and termination
We may suspend or close your account, without refund, if you violate these Terms, share your account, misuse our content, or act in a way that could harm Club Qigong or our community. You can stop using the Services and cancel your membership at any time. To delete your account and data, visit https://clubqigong.com/data/.
16. Disputes, governing law, and arbitration
Let’s talk first. If you have a concern, please contact us first. Most issues can be resolved quickly and kindly.
Governing law. These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules.
Binding arbitration. If we can’t resolve a dispute informally within 60 days, you and we agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will take place in Berrien County, Michigan, or remotely, unless you and we agree otherwise. Either party may instead bring an individual claim in small claims court if it qualifies.
Class action waiver. You and we agree that claims may be brought only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action.
Opt-out. You may opt out of this arbitration agreement by emailing info@clubqigong.com within 30 days of first accepting these Terms, with your name, account email, and a clear statement that you are opting out of arbitration.
If this arbitration agreement does not apply, you and we agree that any dispute will be brought only in the state or federal courts located in Berrien County, Michigan, and we both consent to their jurisdiction.
17. Mobile app
If you use our app from the Apple App Store or Google Play, these Terms apply along with that store’s terms. Apple and Google are not parties to these Terms and are not responsible for the app or its content, support, or maintenance. For app downloads through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. General
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Services.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part will be limited only as much as needed.
- No waiver. If we don’t enforce part of these Terms right away, we can still enforce it later.
- Assignment. You may not transfer your account or these Terms. We may transfer them in connection with a merger, sale, or reorganization of our business.
- Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as outages, natural disasters, or failures of third-party services.
19. Updates to these Terms
We may update these Terms from time to time. We’ll post changes here with a new “Last updated” date, and for significant changes we may also notify you by email or on the site. Continuing to use the Services after changes are posted means you accept the updated Terms.
20. Privacy
Our Privacy Policy explains how we collect, use, and protect your information, and is part of these Terms. To request deletion of your data, visit https://clubqigong.com/data/.
